Proctors Creek Water Reuse Study

Evaluates using treated wastewater from Proctors Creek for industrial cooling, including whether the outfall can handle the flows and where cooling-water blowdown could return. The proposed arrangement could reallocate 1–6 million gallons a day of existing capacity to other projects, but utility approval, hydraulic studies and a separate agreement are required.

Peanut LLC pays the engineer directly for the evaluation, capped at $1.5 million unless the company authorizes more in writing. The EDA receives the executed engineering contract and cost estimate.

The evaluation must consider treatment quality, the cooling-water discharge location, hydraulics and discharge-permit requirements. The published PDF names quality-target and discharge-characteristic exhibits but does not include their contents.

Requires regular progress reports to both parties, a communication schedule and joint ownership of study data and reports. Either party can terminate for an uncured material breach; the company can stop the study on 30 days’ notice and must pay for completed work.

This contract commissions an evaluation only. It does not commit either party to construction, and it expressly does not bind Chesterfield County or its Utilities Department.
